Abstract The linear economic model based on unlimited natural resources has come to an end and been replaced by a circular economy that requires responsible consumption that protects the environment, and seeks to prolong the lifespan of resources. Member States are obliged to adopt policies favouring waste re- use and to do so must increase the production of byproducts and secondary raw materials from industrial processes. To that end, it is essential to determine accurately and according to homogeneous standards the concepts of byproduct and end-of-waste. The failure to do so will mean all the EU legislator's efforts will have been in vain. Now, the main challenge will be to adopt harmonised waste-related policies that oblige the Member States to achieve higher industrial waste re-use rates.
