Abstract Brazil is an emerging country member of the BRICS, the seventh world economy and considered one of the countries with mega-biodiversity. However, it has a duality between economic development and sustainable use of natural capital also showing social and environmental fragility. Public policies try to solve these problems improving science, technology, and innovation by-laws (tax incentives; innovation; science, technology, and Innovation framework) and papers (White; Green). One of the strategic areas considered in these policies is biotechnology, particularly when associated with the development of a green economy, like biofuels. Biotechnology is an area of intense scientific production, and policies that stimulate research and cooperation between public and private sectors to promote innovation, reducing institutional barriers and facilitating access to tax incentives for private companies are substantial achievements for bioindustry development. On the other hand, national policy related to genetic resources access and traditional knowledge associated prevented progress in the commercialization of local biodiversity during 15 years. Policies created by Brazilian governments aligning economic development and natural resources, through genetic resources access and traditional knowledge associated law; are necessary for the national bioindustry development and as a model for other countries.
