| Abstract |
This text contains the presentation given in the framework of the plenary table of the congress "Recycled society, waste and circular economy", where was analyzed the incorporation of the circular economy in the state waste legislation following the Directive ( EU) 2018/ 851 in relation to municipal waste. The work is based on the definition of circular economy and the long-term objectives and questions the fit in the current system. Next, it analyzes the content of Directive (EU) 2018/851 amending the Waste Framework Directive ( WFD), with regard to municipal waste, as well as the different reports from the EU in relation to the evaluation of compliance by the SSMM of the immediate objectives for 2020 in relation to the "recycling society". The work is based on those suggestions and recommendations that the EU proposes, especially to Spain, to achieve the objectives set and which the regulations should incorporate. Subsequently, it studies the basic state current legislation in relation to the analyzed aspects from a critical point of view, seeing what the current situation is and giving a few touches to the situation of the Autonomous communities. Finally, we present brief recommendations and conclusions regarding the future Spanish waste law that have to incorporate the new WFD. This takes into account the risk situation of the Spanish state of not meeting the objectives set, both for 2020 and for the coming long term. |
