Abstract	This Paper has as its starting point the special regime of mining waste. The approval of the new Law 7/2022, of april 8th, on Waste and Contaminated Soils for a a Circular Economy, with an initially renewed regime in terms of waste management, represents a fundamental opportunity to review a regulation that comes from 2009 and to promote a different and more effective planning based on the objectives of protecting the environmetn and human health in the framework of the circular economy concept.
